1. Website use
Content on this site — including photos, project descriptions, timelines and pricing references — is general information and marketing, not an offer, guarantee or contract term. Project photos show past work; results vary with each home’s conditions, materials and selections. Site content belongs to Remodel St. Pete and may not be copied for commercial use without permission.
2. Quotes & estimates
Consultations and walk-throughs are free. Any verbal or written estimate is based on visible conditions and is not binding until a written Agreement is signed by both parties. Unsigned proposals expire after 30 days because material and labor prices change.
3. Scope of work
We perform only the work listed in the Scope of Work (Exhibit A) of your Agreement. Unless specifically included, work does not include design, engineering or surveys; hazardous-material testing or abatement; repair of concealed rot, termite or structural damage; code upgrades to existing systems; landscaping or driveway repair; work outside the immediate area; or HOA submissions. Natural materials vary, and exact matches to samples or existing finishes are not guaranteed.
4. Payment terms
- A deposit is due when the Agreement is signed; progress payments follow the milestones in the Payment Schedule (Exhibit B).
- Each payment is due within 5 days of the invoice or milestone, and is not dependent on loan or insurance funding.
- Checks are payable to HEMJAY LLC; bank transfer or other methods we approve in writing are also accepted. Never pay cash to an individual crew member.
- Late payments incur a charge of the greater of 5% of the past-due amount or $500 for each month (or part of a month) the amount remains unpaid, not to exceed the maximum allowed by law. Returned payments incur the service charge allowed by Florida law.
- We may pause work if a payment is more than 5 days late, and the schedule is extended accordingly.
- Final payment is due at Substantial Completion (passed final inspection, ready for use, or occupied). Minor punch-list items don’t delay final payment; only their reasonable value may be held back until they are completed.
5. Change orders & allowances
Changes to the work, price or schedule are made by written Change Order, which can be approved by signature, email or text. Unless a fixed price is agreed, changed work is billed at cost plus 20% overhead and profit, plus an administrative fee. Work requested or accepted by the owner is payable even without a signed Change Order. Changes required by inspectors, engineers, code updates or HOAs are owner changes. Selections that exceed an allowance are added by Change Order; unused allowance is credited at cost.
6. Hidden conditions & hazardous materials
Pricing is based on visible conditions. If we uncover rot, termite damage, mold, water damage, non-compliant wiring or plumbing, prior unpermitted work, or suspected asbestos or lead, we will tell you before proceeding. Any additional work, testing or abatement is added by Change Order and extends the schedule. For homes built before 1978, we follow the EPA lead-safe renovation rules.
7. Schedule & delays
Start and completion dates are good-faith estimates, not guarantees. The schedule is extended for delays outside our control, including weather and hurricanes, permitting and inspections, material shortages and back-orders, late selections or payments, change orders, and hidden conditions. We are not responsible for delay-related costs such as temporary housing or loss of use. If major material prices rise more than 5% after signing for reasons outside our control, the documented increase is added by Change Order.
8. Your responsibilities
- Provide access, electricity, water and a staging/dumpster area; clear work areas of furniture and valuables; keep children and pets out of work zones.
- Record the Notice of Commencement when required, and obtain any HOA, condo or deed-restriction approvals.
- Maintain homeowner’s property insurance during the project.
- Direct questions to the owner or project manager rather than crew members, and don’t hire our subcontractors directly for 12 months without our consent.
- Owner-supplied materials are your responsibility, and are not covered by our warranty.
Normal construction involves dust, noise and vibration. Minor cracking of adjacent finishes from normal vibration, and wear to lawns or driveways from reasonable equipment access, are not considered damage.
9. Insurance & insurance-funded work
We carry general liability insurance and workers’ compensation coverage (or a lawful exemption) as required by Florida law; certificates are available on request. If insurance proceeds are paying for your project, you remain responsible for the full contract price regardless of your insurer’s decision. We do not pay or waive deductibles, act as a public adjuster, or accept assignments of insurance benefits.
10. Limited warranty
Once the project is paid in full, we warrant our workmanship against defects for one (1) year from Substantial Completion. Report any issue in writing within the warranty period and within 10 days of discovery, and give us the opportunity to inspect and repair it. Our remedy is to repair or replace the defective work, or refund its value, at our option. The warranty excludes normal wear, settlement and hairline cracks within industry tolerances, storms and floods, misuse or lack of maintenance, work by others, owner-supplied items, and pre-existing conditions. Manufacturer warranties pass through to you.
To the fullest extent permitted by law, this limited warranty replaces all other warranties, express or implied.
11. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, consequential or punitive damages (including loss of use, temporary housing or diminished value), and our total liability for any claim relating to a project will not exceed the amounts actually paid to us for that project, except for gross negligence or intentional misconduct or to the extent covered by our insurance.
Use of this website is at your own risk, and the site is provided “as is.”
12. Cancellation & termination
If you sign your Agreement anywhere other than our place of business, you may cancel within three business days as described in the Agreement; we won’t start work or deposit your payment until that period ends, and we refund all payments within 10 business days of a timely cancellation. After that, either party may terminate only as stated in the Agreement. If an Agreement is terminated because of owner nonpayment or breach, or without cause, the owner pays for work performed, materials ordered (including special-order items), demobilization, and agreed lost overhead and profit of 15% of the unpaid contract balance. Special-order and custom materials are non-returnable once ordered.
13. Florida lien law
Under Florida’s Construction Lien Law (Chapter 713, Florida Statutes), contractors, subcontractors and suppliers who are not paid may file a lien against the property. Before final payment we provide the contractor’s final payment affidavit, and on request we provide lien releases from anyone who has sent you a Notice to Owner, for the work paid.
14. Disputes
We’d always rather fix a problem than argue about it, so please tell us in writing and give us a fair chance (at least 15 days) to make it right. Construction-defect claims are subject to the notice-and-cure process of Chapter 558, Florida Statutes. Florida law governs, and the exclusive venue is the state courts in Pinellas County, Florida. The prevailing party in any dispute recovers reasonable attorneys’ fees and costs. As stated in the Agreement, both parties waive trial by jury to the extent permitted by law.
15. Photos & reviews
We may photograph projects and use the images in our portfolio and marketing without your name or address, and may place a yard sign during the work. You can opt out in your Agreement. Nothing in our terms limits your right to post an honest review.
16. Your information
Information you send through our contact form (name, email, phone and project details) is used only to respond to your request and manage your project. We don’t sell your information. Form submissions are processed by our website host, Netlify, and delivered to our business email.
We keep the emails, text messages and other communications you send us, along with project documents and photos, so we can manage your project and keep an accurate record of our work together. To work more efficiently and serve you better, we may use third-party software, including artificial intelligence (AI) tools, to organize, summarize and keep track of these communications and records — for example, to maintain customer records, project details and follow-ups. These tools are used only for our internal business purposes, not to make automated decisions about you, and the software providers may process the information under their own terms and security practices. By contacting us or doing business with us, you consent to this use. If you would prefer that your communications not be processed with AI tools, let us know in writing and we will honor reasonable requests.
17. Required Florida notices
Our Agreement includes the notices required by Florida law, including:
Any claims for construction defects are subject to the notice and cure provisions of Chapter 558, Florida Statutes.
Florida Homeowners’ Construction Recovery Fund — payment, up to a limited amount, may be available from the Florida Homeowners’ Construction Recovery Fund if you lose money on a project performed under contract, where the loss results from specified violations of Florida law by a licensed contractor.
